In the event of any inconsistency between this arbitration provision and any provision contained in any other applicable Guidelines, disclaimer or privacy policy relating to TotalLegal, this arbitration provision shall control. Each arbitration, including the selection of the arbitrator, will be administered by the American Arbitration Association (the “AAA”) according to its Commercial Arbitration Rules and the Supplementary Procedure for Consumer-Related Disputes (together, the “AAA Rules”). GOVERNING LAWS TotalLegal exists solely within the King County in the State of Washington. You agree that regardless of where you reside or where your browser is physically located, your viewing of TotalLegal occurs solely within King County in the State of Washington and that all content and Services shall be deemed to be served from and performed wholly within, King County, Washington, as if you had physically traveled there to obtain such service. These Terms of Use will be governed and interpreted pursuant to the internal laws of Washington, United States of America, notwithstanding any principles of conflicts of law. You specifically consent to personal jurisdiction in Washington in connection with any dispute between you and TotalLegal arising out of these Terms of Use or pertaining to the subject matter hereof. You agree that the exclusive venue for any dispute between the parties arising out of these Terms of Use or pertaining to the subject matter of these Terms of Use will be in the state and federal courts in Washington. 18. WAIVER No failure on the part of TotalLegal to enforce any part of these Terms of Use and no action on the part of TotalLegal shall constitute a waiver of any of TotalLegal’s rights under these Terms of Use whether for past or future actions on the part of any person, provided, however, that only a specific, written waiver signed by an authorized representative of TotalLegal shall have the legal effect of a waiver. 19.
